ABSTRACT
The historical background of the 1982 constitution was the damage caused by the Cultural Revolution, such as political persecution and economic losses for the country. The 1982 constitution itself resembles the 1954 constitution with some important modifications. The philosophical and theoretical basis on which the 1982 constitution was drafted was Marxist historical materialism.
