ABSTRACT

This chapter is concerned with laws to control the international movement of waste and the recycling of ships. The development of international rules controlling the transboundary movements of waste and hazardous waste are examined with a detailed consideration of the Basel Convention, Basel Ban Amendment Protocol and EU Waste Shipment Regulation. The chapter then moves on to describe the growing focus on safe recycling of ships, and the process leading to adoption in 2009 of the IMO Hong Kong Convention. After an analysis of the legal regime contained in the Convention, the application of the Basel regime to ship recycling is examined and the chapter concludes with a review of the EU Ship Recycling Regulation.
