ABSTRACT

The increase in the competition landscape of the telecom sector and the consequential increase in the demand for spectrum form the basis for the discussion in this chapter on TRAI’s regulatory determinations in the second phase. While TRAI was not involved in the initial spectrum allocation and spectrum usage charges (SUC) regime determinations by the licensor, in its initiatives for a unified license (UL), the regulator articulated its initial views on spectrum pricing, which were further elaborated in its recommendations in May 2005. The licensor’s unified access service (UAS) guidelines of December 2005 are also discussed in this chapter, along with whether the scarcity value of spectrum was incorporated into the pricing recommendations and regime. Other recommendations during the period pertaining to capping of access service licenses and combination of technologies under the same license are also discussed.
