ABSTRACT

Chapter 4 argues that to understand the issue in cases concerned with children’s medical treatment as solely that of the best interests of the child, is to neglect to consider the legal and professional duties of doctors to children in their care. This chapter examines the legal duties of doctors to children in their care to work together with parents to agree a treatment plan. It considers the legal duties of doctors to children who do not have a parent advocating for them and those whose parents wish them to be treated in a manner which the doctor, in their professional judgement, cannot agree to.
