ABSTRACT

Chapter 4, ‘Providing a check on prosecutorial decision-making: an analysis of the VRR reform’, is the first of four analysis chapters. This chapter examines the implementation and operation of the VRR reform with reference to its key benefits and limitations. This reform provides a unique mechanism for victims to challenge prosecutorial discretion. While technically constituting a provision of information, the VRR has the ability to rectify inappropriate prosecutorial discretion, and may result in a reversal of the original decision and ultimate conviction. Chapter 4 considers the ways in which the reform addresses or neglects victims’ procedural justice needs throughout the prosecution process.
