ABSTRACT
The present chapter analyses a long period in the US history (1776–1917), during which the US Administration did not give any consideration to whether aggression had to be considered a crime under international law. Nevertheless, this period provided some important precedents for the jus ad bellum, including the notion of anticipatory self-defence. Some of these emerged after or because of a US initiative.
