ABSTRACT

This chapter focuses on creditors who are the ones protected by the responsibilities and obligations discussed in the book, namely the creditors. The chapter identifies who is a creditor, that is someone to whom a debt is owed, and then considers the kinds of debts which can be owed. This is followed by a detailed consideration of the kinds of creditors that a company might have. The focus is on consensual creditors, and much of the discussion explains who unsecured creditors are, on the one hand, and secured creditors, on the other, and the different kinds of unsecured creditors who might be owed money by companies. The chapter finishes with a discussion of the types of protections which creditors might avail themselves of, including requiring the insertion of terms in contracts and monitoring the activities of their corporate debtors.
