ABSTRACT

Torts is the branch of the common law that deals with “civil wrongs.” In any tort action there are four fundamental things that must be proven by the plaintiff: duty, breach of duty, injury, and cause. The most common, at least in numbers, kind of tort suit is the personal injury suit. This is a suit in which the injury alleged is that to a particular person, normally to life, health, physical comfort, and so on. Two other kinds of tort suits are nuisance and trespass. Both involve damage to real property, but could also include personal injuries. They are frequently alleged in the same case, as the factual support for each of them could be very close. A products liability case is a case in which it is alleged that the defendant manufactured or produced a product that was defective and, when it failed, caused injury to the plaintiff.
