ABSTRACT

This chapter examines the key framework of controls that directly impact on business. Environmental Law is an important and burgeoning area with potentially expensive compliance and liability costs for business and industry. The chapter also examines the key framework of controls that directly impact on business. Environmental liability is also very expensive both in terms of compliance costs and failure to comply, which may result in criminal prosecution or a civil claim. In relation to regulation of environmental controls, the UK system revolves around a system of licensing controls that the Environment Agency, or other relevant regulator, will implement, monitor and enforce where necessary. Tort law and environmental law provide the potential for both civil and criminal liability to arise from damage arising from the state of premises and also for harm and pollution to the environment. Environmental permitting requires certain types of business, such as those carrying out power generation, manufacturing and other industrial activities such as waste management.
