ABSTRACT

This chapter examines prisoner disciplinary proceedings. Discipline, order, and control are major concerns of the administrative staffs of correctional institutions. These issues relate to the security of the institution, the safety of institutional staff and prisoners, and the rehabilitation of the prisoners. In recent years, great emphasis has been given by the courts to the disciplinary procedures and practices of prison administrators. The chapter begins with a discussion of due process in general, then moves to the two major Supreme Court cases involving prison disciplinary procedures—Wolff v. McDonnell and Baxter v. Palmigiano. The chapter concludes with a detailed discussion of the due process requirements required in these proceedings, such as a notice of the hearing, the opportunity to present evidence and witnesses, administrative review, and double jeopardy.
