The prosecutor, high court attorney Eggert Claessen, stresses in his arguments that Magnus Hj. Magnusson had admitted in the lower court to the rape of Agustina Guojona Jonasdottir, and also to attempted rape of her in the winter of 1909-1910 when she was only 13 years old. An examination of the prosecution and defense documents, together with the text of the laws cited, provides a clear insight into the status of the sexes, and the weakness of women’s formal position in society. Even female children enjoy limited protection; and while the law makes provision for harsh penalties these are often restricted to certain circumstances or conduct. Magnus’ defense counsel objects to his admissions being applied formally as evidence in the case against him, and once again absolutely rejects the allegations of rape and attempted rape.
