ABSTRACT

The objective of a tender package is to leave as little doubt as to the scope of the works as is reasonably possible, when prices are prepared by tendering contractors. All building contractors must have public liability insurance, and the other insurances necessary to run a construction site, and it is acceptable to ask the contractor to confirm that they are current, and the extent of the cover. There is a 'quick fix' solution, that has been designed especially for building contracts, called adjudication, but this only applies to private householders if it is expressly mentioned in the contract. For a small fee, an adjudicator is nominated and both sides are given three or four weeks to convince this person of the merits of their case. The adjudicator will then issue a decision, for example that one side is to pay the other some money, or that some of the work is defective.
