ABSTRACT
This chapter introduces the constitutional basis of criminal procedure rights for those persons accused of criminal activity. Changes in the United States Constitution based on post-Civil War amendments and the concept of selective incorporation of the Bill of Rights into the due process clause of the Fourteenth Amendment receive due consideration. Focus is given to state and federal court organization and how cases proceed from the initial prosecution steps through the appellate process.
