ABSTRACT

Arrests and the Fourth Amendment probable cause standard that must exist to justify the seizure of the person is presented in this chapter. The material presents a critical analysis of the facts and circumstances that would lead an officer to conclude that a person may be taken into custody. The use of informants and the validity of their data in determining probable cause are discussed and evaluated. Consideration is given to circumstances that require arrest warrants and to situations where arrest warrants are not constitutionally mandated.
