ABSTRACT

This chapter explains the Fourth Amendment requirement of search probable cause and details the concept of specificity both of the place to be searched and the items to be seized. Consideration is given concerning when a warrant is required and to the facts and circumstances that give rise to probable cause. Informant probable cause is illustrated, and the chapter offers due consideration to informant believability under the totality of the circumstances test. This material presents knock and announce requirements, the scope of a search, and concepts of stale probable cause.
