ABSTRACT

This new chapter introduces searches of Internet-connected and Internet-connectable devices and their relationship with the Fourth Amendment searches. Cell phones, automobile data recorders, home and other stationary cameras, personal fitness devices, and other human-related devices that collect data generally require warrants or a well-recognized exception to permit prosecutorial access to the information. When Internet-connected smart devices store data with third parties, case law does not always offer clear-cut answer to search and seizure issues.
