ABSTRACT

This book is a preliminary statement of fairness theory (FT). As such, it should be subjected to critical analysis and empirical testing. Given the fact that politicians will forge ahead and implement criminal justice policies, FT may be a better rationale for any proposed legislation or administrative action than what typically is offered. Projects could be undertaken to promote the primary, secondary, and tertiary prevention of exploitative, retaliatory, and spiteful forms of crime, as well as efforts to reduce various maladaptive behavioral responses of the entire criminal justice system. Taking a strategic approach to FT would enable legislators and other policymakers to enact changes specifically designed to promote fairness for victims, offenders, their families, and the entire community. Quantitative research to test FT could include the analysis of existing datasets, factorial surveys, and both laboratory and field experiments. Qualitative approaches could include ethnographic studies and focus groups.
