ABSTRACT

Deception is relevant to all forensic settings and situations where expert opinions on mental state are proffered. This chapter on civil law will consider applications of deception analysis in tort claims and eligibility claims. Specific circumstances and techniques for assessing faked cerebral injury, pain, and post trauma reactions—common targets of civil claims—are addressed in subsequent chapters. Before considering deception in this dimension, evaluators and third-party bias must be accounted for, as well as the all-to-common use of limited deception-detecting methods and measures within the IME and other civil-forensic examinations.
