ABSTRACT
It is now commonplace for documents to be signed electronically rather than by the traditional “wet ink” approach. In light of this BIMCO has produced an electronic signature clause which may be incorporated into its standard form agreements. The BIMCO Electronic Signature Clause 2021 has been incorporated into Shipsale 22 at clause 27.
Detailed commentary on the law relating to electronic signatures is beyond the scope of this book but some observations on the provisions of clause 27 of Shipsale 22 are included below.
