ABSTRACT

The parties to ship sale agreements may agree to modify or supplement the standard terms of their agreement. While modifications will often be made by the amendment of specific printed terms in the standard form agreement, usually supplements will be made by the inclusion of certain additional provisions which aim either to regulate the working of the parties’ relationship under the agreement or to regulate issues that are specific to a particular shipping sector or sale transaction.

These additional provisions will be included in the sale agreement in what are widely referred to as “Additional Clauses”. Box 24 in Part I of Shipsale 22 provides a space for the parties to insert the numbers of any additional clauses that they have agreed to add to the agreement.

There is no established market practice in relation to the subject matter of additional clauses but in ship sale agreements governed by English law such clauses often cover the following matters.
