ABSTRACT

The nature and extent of the buyer’s supplies will vary widely from one project to the next but may typically include specialised cargo handling gear, navigational and telecommunications systems or, in the case of cruise vessels, catering and other hotel equipment. The buyer is also required to provide manuals and other information to facilitate installation of the supplies by the builder. The supplies themselves are to be provided by the buyer in accordance with the building and testing schedules provided for under Clause 20 of the NEWBUILDCON Form. The buyer will obviously wish as far as possible to render the project as “turnkey” as possible, making the builder responsible for demonstrating the full functionality of the completed unit; the builder will in contrast normally seek to limit its exposure to the obvious risks inherent in such a commitment.
