ABSTRACT

Guam is a self-governing possession of the USA, and the laws of the USA, including the Copyright law, apply equally to Guam. Therefore all works published in Guam for which copyright is sought have to be deposited with the Library of Congress in Washington, D.C. There are no indigenous legal deposit laws except for government documents. The only publications which the Library of Congress would be entitled to receive by law would be those which either the compiler of laws or the Legislature decided to copyright. A provision was made for this in this same law. Provision for the legal deposit of government documents is very weak in Guam. No library is specifically mentioned. Therefore access and preservation cannot be guaranteed. Section 42022 is a definite legal deposit clause since it is unequivocal in its direction and meaning as to what has to be deposited, when, by whom and where.
