ABSTRACT

This concluding chapter shows that externalization is on the top of the European Union (EU) agenda, despite the risks of serious violations of migrants’ human rights. Libya is only the most blatant case, but serious concerns have also been raised with regard to the EU-Turkey statement, and in general to the increase of deals/pacts/memoranda with unsafe third countries without respecting the procedures established in the Treaty on the Functioning of the European Union (TFEU) for the conclusions of agreements, thus precluding a political and judicial control. The Union’s action on the international scene shall be guided by the principles which have inspired its own creation, development and enlargement, and which it seeks to advance in the wider world: democracy, the rule of law, the universality and indivisibility of human rights and fundamental freedoms, respect for human dignity, the principles of equality and solidarity, and respect for the principles of the United Nations Charter and international law.
