ABSTRACT

This chapter discusses the role of the State in protecting children's rights when they are in need of care, protection, and support. Responsibility for child protection and children's services is devolved to each of the four nations of the UK. All practitioners who may have concerns about a child's welfare should make a referral to the local authority social care team, which has primary responsibility for safeguarding children. In addition to any other duties imposed by the Children Act, local authorities are under a duty to safeguard and promote the welfare of children in need and to promote the upbringing of children by their families. Local authorities must provide accommodation for children who have been taken into police protection. A Child Assessment Order is an order of court authorising a local authority to make an assessment of a child's health and development with a view to deciding whether further action should be taken to protect the rights of the child.
