ABSTRACT

This chapter focuses on the rights of children in the criminal justice system in England and Wales. The rights of children under the English criminal justice system have in the past come under significant criticism for failing to give adequate recognition to children's age and vulnerability. A Child Safety Order (CSO) may be granted to ensure that a child receives ‘care, protection and support' and ‘is subject to ‘proper control', in order to prevent a repetition of the kind of behaviour for which the order was granted. The aim of Parenting Order is to provide guidance and support to a parent or carer with the aim of preventing a child from repeating the conduct which led to the CSO being applied: in other words, the PO is a means of ensuring compliance with the terms of the CSO. Any youth caution or conditional youth caution must be given in the presence of an ‘appropriate adult'.
