ABSTRACT

Auctions on the Internet are the latest online trend and the trendiest are the airfare auctions held on the World Wide Web. At the time of writing, a round trip ticket from Montreal to Toronto was being auctioned with the starting price at $99. The person seeking to purchase a seat on a flight names the price they would be prepared to pay for an airline ticket and the airline tries to match the price and sell a seat on its flights with empty seats. The higher one bids, the better the likelihood of securing a seat. In the case of airline seat auctions, the position becomes reversed, in that the person who offers becomes the visitor to the Web site. In the instance of an auction carried out over the Internet, the primary issue at stake in the determination of a contract is whether the parties intended the contract to be concluded.
