ABSTRACT

This chapter sets forth the basics of federal and state labor law. The Fair Labor Standards Act of 1938 (FLSA) is the primary federal law governing wages and hours. There are important exemptions for agriculture in FLSA that are discussed in this chapter. Federal immigration law and its application to agricultural employers is discussed. Also discussed are the employment at will doctrine, prohibitions on employment discrimination and harassment, the Family and Medical Leave Act (FMLA), the ACA, and a variety of state laws designed to protect employees.
