ABSTRACT

This chapter covers constitutional and federal statutory protection for police officers in the workplace—their First Amendment right to freedom of speech, Fourth Amendment protection against workplace searches, Fifth Amendment protection in police disciplinary proceedings, Fourteenth Amendment protection against arbitrary restrictions on their personal liberty, right to procedural due process in police disciplinary actions, Title VII protection against workplace harassment and employment discrimination, and Fourteenth Amendment protection against excessive or unnecessarily broad diversity policies. The Chapter concludes with a discussion of constitutional accountability under 42 U.S.C. § 1983, a federal statute which imposes civil liability for conduct committed under color of state law that violates constitutional rights.
