ABSTRACT
Chapter 9 covers constitutional protections applicable during the trial and punishment phase of a criminal case—namely, double jeopardy; the right to a speedy trial; the right to a public trial; the right to confront adverse witnesses; the right to a fair and impartial tribunal; the right to a jury trial; protection against prejudicial pretrial publicity; the duty to disclose favorable evidence to the defense; and Eighth Amendment protection against cruel and unusual punishment, including restrictions on the death penalty and protection inside prisons.
