ABSTRACT

Personalty is not the only form of property subject to governmental constraints. There are restrictions on the types of renovations and extent of remodeling that the owners of buildings on the National Register of Historic Buildings can do to their real property. A good exercise might be to go through a list of the personal property items and examine the ways in which their uses are limited by social conventions and laws. Land-use regulation is perhaps the most highly developed example of police power delegation. Most property owners benefit from the regulations and find land-use restrictions bearable aggravations that go with the territory like mowing the lawn and paying property taxes. The shore-land zoning ordinance preserves nature, the environment, and natural resources as they were created and to which the people have a present right.
