ABSTRACT

Intercountry adoption is a subject that has seized much popular attention, and on occasion has attracted news headlines about celebrity adoptions. Intercountry adoption remains a controversial area that generates different views about its utility and necessity. Intercountry adoption, or international adoption, as it is sometimes known, has occurred historically alongside various causes of population displacement and migration. Finally, intercountry adoption is often appealed to as a solution to children orphaned as a result of natural disasters. The Hague Conference viewed the involvement of non-Member States as indispensable, given that many children subject to intercountry adoption arrangements originated from these ‘sending’ States. he debate on whether the intercountry adoptions are in the best interests of the child or not will be captured later. Despite the attempts to provide better international legal regulation of intercountry adoption there are remaining concerns about the success of the overall project of international adoptions.
