ABSTRACT

Environmental issues are addressed in EU air law at several levels. First, framework regulation 2018/1139 and supplementing acts ensure compliance of aviation products, parts and non-installed equipment with environmental protection requirements arising from ICAO standards set forth in Annex 16 to the Chicago Convention. Second, where a noise problem has been identified at an EU airport according to directive 2002/49 and the legislation applicable in a member state, the member state concerned shall follow procedures for the introduction of noise-related operating restrictions established in regulation 598/2014. After Brexit, regulation 598/2014 will cease to apply to and in the UK, and Britain will need to decide on the existing restrictions and on possible ways to apply or replace the regulation. However, without a UK-EU27 post-Brexit arrangement, the European Commission and EU27 member states will likely lose their right under regulation 598/2014 to have a say on restrictions imposed in the UK.
