ABSTRACT

The impact of Brexit on UK-third party relations will depend on the nature and working of current international agreements entered into by the EU and its member states or by the EU itself. Current comprehensive international arrangements for air services between the EU and third parties, including the European Economic Area agreement, the EU-Swiss aviation agreement, the European Common Aviation Area agreement, Civil Aviation Authority agreements, Euromed aviation agreements and vertical air transport agreements, will cease to apply to the UK after Brexit. The UK government has argued that Brexit will unlock the potential in UK-third party relations including aviation relations. Whereas the UK’s commitment to be bound by EU-third party agreements seems clear, neither this commitment nor the EU’s notification addressed to third states is sufficient to ensure that those states will continue to apply their agreements with the EU to the UK during the transition period.
