ABSTRACT

Technical requirements in aviation have been directly harmonised at the EU level in order to establish a high uniform level of safety. Pan-EU validity of certificates of airworthiness, aircrew, air traffic controllers or air operator credentials, together with the Treaty freedoms, has led to internationalisation of aviation industrial activities and the aviation labour market in the EU. The departure of the UK from this framework will lead to technical and legal barriers that may harm the aviation industry and also jeopardise safety on both sides of the English Channel. After Brexit, the UK will need to adopt new measures to safeguard the full implementation of these international standards. This may be achieved by a UK-EU27 arrangement for the extended application of the EU aviation safety and technical legacy, or by adoption of new British national regulations. There are also other EU aviation safety provisions outside the regulation 2018/1139 framework that will be hit by Brexit.
