ABSTRACT

The fact that Muhammad insisted on his right to express his thoughts in public and the fact that he recognized the right of others who do not share his views and beliefs to seek protection, indicates that he would endorse a universal freedom of thought and freedom to publicly express one's thoughts. A guiding principle that could help achieve the proper adoption of these rights is to be mindful of the power dynamics among social groups and the power differential between the people and those holding power over them. Additionally, human rights are born in moments of crises and challenges; they are the byproduct of circumstance. Every law can be circumvented through loopholes; legal guarantees are often suspended under some pretext or another; and the State, through its agents, will always find ways to grab more power enabled by the powerful interest groups who sustain it.
