ABSTRACT

Chapter 4 examines CHP as an element of the EU climate action, embedded in the energy efficiency pillar of the European climate-energy policy. This part of the book discusses combined heat and power in the legislation on emissions (both the regime on industrial emissions with the Industrial Emissions Directive – Directive 2010/75/EU as well as the EU Emission Trading System with revised EU ETS Directive – Directive 2003/87/EC) and the correlations between regulatory approach dedicated to CHP and renewable energy sources (Directive 2001/77/EC; Directive 2009/28/EC, and Directive (EU) 2018/2001). Continuing the theme of cogeneration in the climate-energy policy of the EU, Chapter 4 evaluates the legal environment for enhancing energy efficiency and searching for a place for CHP within it. The analysis covers the CHP Directive (Directive 2004/8/EC), the Energy Service Directive (Directive 2006/32/EC), the Action Plan for energy efficiency of 2006, and the Energy Efficiency Directive of 2012 (2012/27/EU).
