ABSTRACT

This chapter explains the ECO Treaty on law applicable to international contracts. It discusses the conditions as to use the ECO and looks into the Articles of the ECO that are most often used. The ECO applies to contractual obligations in any situation involving a choice between the laws of different countries. Art. 5 ECO takes effect only in case no choice of law was made by the parties to the consumer contract. Art. 6 ECO is also a special provision, which applies to individual employment contracts. These employment contracts also have to be international contracts, in order for the ECO to apply. The ECO deals with the applicable law to international contracts, that are relevant in case such contracts have been breached by a party. Art. 5 ECO mentions the conditions for a contract to be a consumer contract under the ECO Treaty.
