ABSTRACT

There has been tremendous progress in the opening up of opportunities for all people in the labor market. No occupation or career is out of reach for anyone with the necessary qualifications, at least on the surface. Moreover, a raft of federal social policies protects all groups from workforce discrimination, most recently the 2019 Supreme Court ruling that an employer who fires an individual merely for being gay or transgender defies the Title VII stipulation of the 1964 Civil Rights Act. Title VII prohibits employers from discriminating against employees and job applicants based on race, color, religion, sex, and national origin ( Bostock v. Clayton County, Georgia, 2020). The landmark ruling offers the same federal protections against workplace discrimination for LGBTQ workers that have been enjoyed by every other group of workers in the United States.
