ABSTRACT

This chapter explores the implications of the approach of the book for other areas of private law (apart from property). It concludes that the common law of tort and contract is largely mutually beneficial and therefore consistent with the approach advocated here, which is not to say that these could not be improved. It concludes, however, that much of criminal law is not consistent with the approach of this book, arguing for the legalisation of drugs and the repeal of other victimless crime laws, and for the reform of laws and procedures that disadvantage blacks and other minorities.
