ABSTRACT

The conflict in Afghanistan, which has lasted for nearly four decades, can be roughly separated into four periods. The reasons for the non-inclusion of transitional justice were linked to the position of the alleged perpetrators in the transitional Afghan Government. The United States’s unrestrained hand in these most important political affairs of the country left a feeling of disfranchisement and resentment amongst the Afghans involved. In December 2005, the so-called Peace, Reconciliation and Justice in Afghanistan Action Plan of the Government of the Islamic Republic of Afghanistan was adopted by the cabinet and launched. The amnesty bill from 2006/2007 was used as a legal basis for what was called the Afghanistan Peace and Reintegration Programme, which started in August 2010 with the aim of bringing in Taliban fighters.
