ABSTRACT

In general, a crime consists of one or more actors (parties) who perform certain acts or omissions that result in an identified harm with the specified mental state occurring concurrently with the act. The prosecutor must prove each and every element in the preceding paragraph. This chapter covers all of these elements, including parties to the crime, criminal act requirements and criminal omission, the criminal state of mind, causation, and concurrence of the act and state of mind. This chapter also explores related legal concepts including attendant circumstances, strict and vicarious liability, and lesser included offenses.
