ABSTRACT
The key provisions of the Insurance Act 2015 as they relate to the treatment of breaches of warranties and other provisions are outlined. The chapter critiques the effectiveness of the relevant sections, identifying a number of shortcomings, particularly in relation to s11 of the Act. The analysis concludes that, although it is an improvement on the previous status quo, the Insurance Act represents a missed opportunity.
