ABSTRACT

Chapter 10 concludes and discusses key issues in regulating a community of users with no provider or issuer to provide accountability. There is a risk of regulatory arbitrage if there are significantly different approaches adopted in different parts of the world. There is some degree of suitability for self regulation given the way the systems are constructed. There is also the question of whether new laws and regulations need drafting or whether existing ones can be amended to tie the new products in and a consideration of who is best placed to provide an international response. The 2008 financial crisis both displayed the importance of international co-operation in a rapidly changing situation but also showed that regulation is not the whole answer. The chapter ends with a consideration of what the essentials of good regulation are.
