ABSTRACT
This chapter explores the ongoing dispute over court orders demanding journalists produce notes, tapes or documents (subpoena duces tecum) or orders requiring journalists testify in court (subpoena ad testificandum). The First and Fifth Amendment protections available to journalists are described, along with the protections of state shield laws. The law regarding search warrants is presented, along with Department of Justice guidelines limiting subpoenas or search warrants directed at journalists.
