ABSTRACT

The aims of the Agency were to disrupt organised crime by removal and recovery of criminal assets either by undertaking direct investigations or assisting other law enforcement agencies. There are three types of investigations which can be undertaken under Part 8 Act. These are confiscation investigations, civil recovery investigations and money laundering investigations. For a production order in a confiscation investigation or a money laundering investigation the application will be to the Crown Court. Part 1 of the Act sets up the Assets Recovery Agency which was to be headed up by a director. This Agency was a new concept in United Kingdom law and a new approach in fighting crime. In addition, the Agency was to undertake any taxation investigation under the Proceeds of Crime Act in those cases where it is believed that there is income or profit on which tax is payable and they are the proceeds of criminal conduct.
