ABSTRACT
Numerous car and boat accidents occur at nighttime. In such cases, it is not unusual for one party in the accident to claim that the headlights, taillights, running lights, etc. of the other party were not on at the time of the accident. Of course, if the lights in fact were not on, there is a legitimate issue concerning the visibility of the unlit vehicle or boat, and the prudence of the person operating it.
