ABSTRACT

In view of the fact that a series of subcontracts is involved in an international construction project, the expression ‘international construction contract’ is a misnomer. A schedule of works may be amended at a later date by mutual consent of the employer and the contractor, but at the time of negotiation a schedule must be discussed, and its final version must be attached to the contract in the form of an annex. Amendments may be requested either by the employer or by the contractor unless changed circumstances require them. This means that an international construction contract develops as the stages in it are completed. In an international construction contract, a contractor undertakes substantial obligations, and an employer seeks warranties from it. The issues on which an employer seeks warranties depend upon the nature of the obligations a contractor undertakes.
