The Landscape Architect/Contract Administrator should attempt to agree the value of any variation with the contractor before the variation works are carried out. The model Landscape Architect’s/Contract Administrator’s Instruction provided by the Landscape Institute has a summation at the bottom. A Final Certificate cannot be issued until all the defects have been remedied and a Certificate of Making Good, specifying the date on which the contractor’s responsibilities in this regard were discharged, has been issued in respect of each and every part of the works. The Landscape Architect/Contract Administrator should also bear in mind that the contractor may be entitled to loss of profit and/or a contribution towards its overhead expenses if the overall value of a contract is substantially reduced as a result of variations. In order to maintain a successful practice and correctly administer contracts, the professional practitioner must be diligent and methodical in the keeping of drawing office records.
