ABSTRACT

The definition of hearsay evidence, the statutory exclusion from the hearsay definition, and the exceptions to the hearsay rule of exclusion that allow admissibility of hearsay evidence receive extensive treatment in this chapter. This material details the history, development, and use of the hearsay rule and demonstrates significant exceptions to the rule that allow the admissibility of hearsay evidence. Analysis and examples of major exceptions that are presented include spontaneous utterances, business records, family history, prior testimony, dying declarations, declarations against interest, confessions, and other residual exceptions.
