ABSTRACT

A demonstration of how evidence is treated with respect to pretrial motions directed toward admission and exclusion of evidence and to general admissibility at trial, including the order in which evidence will be presented, receives significant discussion in this chapter. The role of the judge and of the attorneys in offering and challenging evidence becomes apparent in this material. Consideration is given to the prosecuting attorney and defense attorney responsibilities, with respect to introducing and presenting evidence as well as the role the jury possesses in evaluating evidence. The chapter presents a discussion concerning the difference in admissibility and weight of direct and circumstantial evidence.
